FrankWeatherTerms of Service
These Terms of Service ("Terms") govern your use of the FrankWeather desktop application (the "app") and the frankweather.com website (the "site"), together the "Service," provided by FrankWeather ("we," "us"). By installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Your use of the app is also governed by the End User License Agreement (EULA), and your data by the Privacy Policy.
1. The Service
FrankWeather displays weather information sourced from public providers (NWS, NOAA, SPC, NHC, USGS, and others). We do not generate forecasts or warnings; we present third-party data, which may change, be delayed, or become unavailable. Tools such as storm-cell projection and ETAs are simplified estimates for convenience only.
2. Not for emergency or life-safety use
The Service is provided for general informational and convenience purposes. It is not a substitute for official warnings or professional advice and must not be used as your sole or primary source for decisions affecting safety, life, or property. You are solely responsible for monitoring official sources and acting on official guidance.
3. Free for everyone
FrankWeather is free software: every feature is available to everyone at no charge, with no account, no advertising, and no tracking. There is no trial, no paid tier, and no license key. If you purchased a Pro license under our earlier paid model, thank you — the app is now free for everyone, and nothing you had access to has been taken away.
4. Donations
FrankWeather is supported by voluntary donations. Donations are optional support for development — they are not purchases, do not buy features, access, support entitlements, or services, and are not tax-deductible (we are not a registered charity). Donations are processed by third-party providers under their own terms and are generally non-refundable; if you donated in error, contact support@frankweather.com and we'll help where we can.
5. Earlier purchases
Licenses sold before the app became free remain valid but no longer gate anything. If you have a question about a past purchase, contact support@frankweather.com and we'll make it right.
6. Acceptable use
You agree not to:
- copy, modify, reverse engineer, decompile, or attempt to extract source code or signing keys, except where such restriction is prohibited by law;
- resell the app, or redistribute modified or repackaged copies of it;
- tamper with the update channel or impersonate official FrankWeather releases;
- use the Service to overload or abuse the third-party data providers; or
- use the Service unlawfully or in violation of third-party providers' terms.
7. Updates
The app can check for and install updates. We may release updates that change, add, or remove features. Continued use after an update means you accept the updated app.
8. Intellectual property
The app, the site, and the FrankWeather name and logo are owned by us and protected by law. Weather and map data remain the property of their respective providers and are used under their terms; please consult those providers for attribution and reuse.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT WEATHER DATA IS ACCURATE, TIMELY, COMPLETE, OR UNINTERRUPTED.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROPERTY, OR LIFE, ARISING FROM OR RELATED TO YOUR USE OF OR RELIANCE ON THE SERVICE OR ANY WEATHER DATA. THE SERVICE IS PROVIDED FREE OF CHARGE; OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF TEN US DOLLARS (US$10) OR ANY AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access (including deactivating keys) for violation of these Terms. The disclaimers and liability limits survive termination.
12. Governing law
These Terms are governed by the laws of the United States and the state in which the operator is located, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to informal resolution.
13. Changes to these Terms
We may update these Terms; material changes will be posted here with a new date. Continued use means acceptance.
