End User License Agreement
This End User License Agreement ("EULA") is a legal agreement between you and FrankWeather ("we," "us") for the FrankWeather desktop software, including updates and documentation (the "Software"). By installing or using the Software, you agree to this EULA, the Terms of Service, and the Privacy Policy. If you do not agree, do not install or use the Software.
1. License grant
We grant you a free, personal, non-exclusive, non-transferable, revocable license to install and use the Software — every feature included — on devices you own or control, for your own personal or internal business use, subject to this EULA. No license key, account, or payment is required.
2. Earlier license keys
FrankWeather was previously sold with license keys. Those keys are no longer required — the Software is now free for everyone. Past purchases remain appreciated and nothing previously unlocked has been removed.
3. Restrictions
You may not, except to the extent the law forbids restricting these acts:
- copy (except a reasonable backup), distribute, rent, lease, lend, or host the Software for others;
- modify, adapt, translate, or create derivative works of the Software;
- reverse engineer, decompile, or disassemble the Software, or attempt to derive source code, embedded keys, or the signing/verification scheme;
- remove or alter any proprietary notices; or
- tamper with the Software's update mechanism or distribute modified builds as official releases.
4. Ownership
The Software is licensed, not sold. We and our licensors retain all right, title, and interest in the Software, including all intellectual property. Weather and map data displayed in the Software are owned by their respective providers (NWS, NOAA, SPC, NHC, USGS, and others) and are used subject to their terms.
5. Updates
The Software may download and install updates automatically or with your confirmation. Updates are part of the Software and are covered by this EULA. We may change, add, or remove features in updates.
6. Third-party data and services
The Software relies on third-party data feeds and services. Their availability, accuracy, and terms are outside our control, and your use of that data is subject to the providers' terms.
7. No life-safety reliance
The Software is a convenience tool and is not an official emergency-alert system. Do not rely on it for decisions affecting safety, life, or property. Always follow official sources and emergency guidance.
8. Disclaimer of warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE OR WEATHER DATA WILL BE ACCURATE, TIMELY, UNINTERRUPTED, OR ERROR-FREE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROPERTY, OR LIFE, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SOFTWARE OR ANY RELIANCE ON WEATHER DATA. THE SOFTWARE IS PROVIDED FREE OF CHARGE; OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF TEN US DOLLARS (US$10) OR ANY AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE MONTHS BEFORE THE CLAIM.
10. Termination
This EULA is effective until terminated. It terminates automatically if you breach it. On termination you must stop using and uninstall the Software. The disclaimers, ownership, and liability sections survive.
11. Export and compliance
You agree to comply with all applicable laws, including export-control and sanctions laws, in using the Software.
12. Governing law
This EULA is governed by the laws of the United States and the state in which the operator is located, without regard to conflict-of-laws rules.
